MAP Pricing Policy for Flipper Aquarium Products, Inc.

  1. Introduction: Flipper Aquarium Products, Inc. is dedicated to creating world class aquarium products, and we are dedicated to upholding the highest quality standards with our products. This Minimum Advertised Price (MAP) Pricing Policy has been developed to protect the brand image, maintain healthy profit margins for our authorized resellers, and provide a level playing field for all our partners.
  2. Covered Products: This MAP Pricing Policy applies to all Flipper Aquarium Products, Inc. sold in the United States, including but not limited to aquarium cleaning tools, aquarium viewing tools, feeders, and other related accessories (collectively referred to as "Covered Products").
  3. Minimum Advertised Price (MAP): The MAP for each Covered Product will be communicated by Flipper Aquarium Products, Inc. and may vary for different products. Authorized resellers are required to advertise the Covered Products at or above the specified MAP. The MAP applies to the advertised price in any media format, including but not limited to print, catalogs, websites, email newsletters, social media, and any other publicly available advertisement.
  4. Pricing Guidelines: 4.1. Resellers have the freedom to sell the Covered Products at any price they choose, provided that the advertised price is at or above the MAP. 4.2. Bundling or package deals that include Covered Products must maintain the MAP for each individual product. The total price can be lower due to discounts applied to non-Covered Products. 4.3. Resellers are responsible for setting their own resale prices. Flipper Aquarium Products, Inc. will not interfere with the resale price decisions made by authorized resellers.
  5. Violations: 5.1. Flipper Aquarium Products, Inc. reserves the right to monitor the marketplace to ensure compliance with this MAP Pricing Policy. 5.2. If a reseller is found to be advertising any Covered Product below the MAP, Flipper Aquarium Products, Inc. will take appropriate actions, which may include issuing warnings, limiting product availability, suspending or terminating the reseller's account, or any other measures deemed necessary. 5.3. Flipper Aquarium Products, Inc. will determine, at its sole discretion, whether a violation of this MAP Pricing Policy has occurred and the appropriate actions to be taken. Such determination may be made on a case-by-case basis. 5.4. Flipper Aquarium Products, Inc. may update or modify this MAP Pricing Policy from time to time. Resellers should periodically check for updates on our website (www.flippercleaner.com).
  6. Authorized Resellers: 6.1. Only resellers who have been approved and authorized by Flipper Aquarium Products, Inc. are permitted to sell the Covered Products. 6.2. Flipper Aquarium Products, Inc. may grant or revoke reseller authorizations at its sole discretion.

By advertising or selling Flipper Aquarium Products, Inc., authorized resellers acknowledge their understanding of this MAP Pricing Policy. Failure to comply may result in the termination of the reseller's authorization to sell Flipper Aquarium Products.

Please note that this MAP Pricing Policy is not a contract, and Flipper Aquarium Products, Inc. reserves the right to make individual determinations and take appropriate actions to ensure compliance with the policy.
